This Privacy Policy governs the manner in which Smatch collects, uses, maintains and discloses information collected from users (each, a "User" or "You" and in the possessive form, "Your") of the Smatch application and websites ("Smatch", "Smatch App", "App", "Application" and "Websites"). This privacy policy applies to the application and all products and services offered by Appik Studio Sarl, and applies to all correspondence and communications between Appik Studio Sarl and its Users and shall be binding on the parties, unless so specified herein.

By downloading and/or using the App and/or benefiting from the services, Users expressly consent to our collection, use and disclosure of your information in accordance with the terms of this Policy. If you do not agree with this Policy, you must not use the Service.

Appik Studio Sarl reserves the right to modify this Privacy Policy at any time, without prior notice. Your continued use of the Service after any modifications indicates your acceptance of the modified Policy. It is your responsibility to review this Policy periodically.

  • Information About Others, such as the names, email addresses and other information about individuals you invite to use our Services, register to receiving coaching services or authorize to receive notifications. You represent and warrant that you have obtained all necessary consents from such individuals;
  • Other Information You Choose to Provide, such as when you participate in a survey, contest, promotion, quiz or interactive area of the Services, request technical or customer support, communicate with us via third-party social media services or otherwise communicate with us.

Information We Collect Automatically

When you access or use our Services, we automatically collect information about you, including:

  • Log Information: We collect log information about your access to and use of our Services, including the type of browser you use, access times, pages viewed, your IP address and the page you visited before navigating to our Services.

If you wish to deactivate your account, please visit our App Settings page and click on "delete your account". Please note that we may retain certain information as required by law or for legitimate business purposes.

Location Information

When you first launch any of our mobile applications that collect location information, you will be asked to consent to the application's collection of this information. You can subsequently stop the collection of this information at any time by changing the preferences on your mobile device. Note that disabling location services may affect the functionality of the Service.

Security

We implement reasonable security measures to protect your personal data. However, no method of transmission over the Internet or method of electronic storage is 100% secure. APPIK STUDIO SARL CANNOT GUARANTEE THE ABSOLUTE SECURITY OF YOUR DATA AND DISCLAIMS ANY LIABILITY FOR UNAUTHORIZED ACCESS, USE, OR DISCLOSURE OF YOUR INFORMATION RESULTING FROM CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL, INCLUDING HACKING, DATA BREACHES, OR SYSTEM FAILURES.

Children's Privacy

The Service is not intended for individuals under 16 years of age. Appik Studio Sarl does not knowingly collect personal data from children under 16. If we become aware that we have collected data from a child under 16, we will take steps to delete such information. Appik Studio Sarl disclaims any liability arising from the use of the Service by minors.

Governing Law

This Privacy Policy and all matters arising out of or relating to it shall be governed by the substantive laws of Switzerland, without regard to conflict of law principles. Any controversy, claim or dispute shall be subject to the exclusive jurisdiction of the ordinary courts of Lausanne, Switzerland.
